Is it a legal requirement for caravan parks to have an FRA?

I try to avoid spouting legal jargon as it can often appear scaremongering but it is worth answering the question.

The relevant legislation is the Regulatory Reform (Fire Safety) Order 2005 which applies across England and Wales and came into force on 1 October 2006. The Order applies to almost all buildings, places and structures other than individual private homes. 

The Order requires the "responsible person" requires a Fire Risk Assessment has been completed by a competent person.

But how does this apply to caravan parks? 

S.5 of the Caravan Sites and Control of Development Act 1960 grants a Local Authority the power to attach conditions to site licences and the Model Standards provide some indication of “good practice standards”. It is a common misconception that the Model Standards themselves are legislation, rather they identify the standards “normally expected as a matter of good practice on sites.” Having worked on parks across the UK, I can say with some certainty that no two parks are the same which makes legislating the Model Standards difficult and so the final say is left to the Environmental Health Officer (EHO). 

 

There are two sets of model standards:

  • Model Standards 1989 covering holiday caravan parks

  • Model Standards 2008 covering residential caravan parks

  •  For parks which have a mixture of residential and holiday caravans, the 2008 standards apply.


 The Model Standards 2008 directly refer to the Order:

 

"The site owner must be aware of and comply with their obligations under the Regulatory Reform (Fire Safety) Order 2005, in particular the requirement to carry out a fire risk assessment. "

The Model Standards 1989 obviously pre-dates the RRO however, all site licences I have seen include a clause mirroring the above requirement.  

So, a slightly long answer but it's certainly worth consideration. 

Who can conduct a fire risk assessment? 

The term ‘competence’ is often banded around when it comes to FRA. However, the truth is that it is equally important to have someone who understands the hazards associated with your industry. I'll explain with a short story:

 

A fire risk assessor had been contracted to assess a residential park and was grilled by the park owner. The ex-council park had six-foot fences between the caravan units and there was some disagreement as to their compliance with the updated 2008 Standards. Although the assessor is very qualified and experienced it is clear that they do not have the experience in the park industry.
